Data Protection Act

All personal information provided by you and any other information relating to your account(s) will be treated in confidence and will not be disclosed to any third parties (except to insurers and to Sony, its agents and sub-contractors), including other members of the Bank of Scotland Group, except where permitted by law or where your consent has been received. However information may be shared with other financial organisations to protect both ourselves and our customers against fraud. The information will be held in Bank of Scotland's and Sony's computer systems and may be used in the following ways:
  • The information will assist Bank of Scotland in providing the service for which you have applied.
  • The information will assist Sony in providing the Loyalty Scheme*.
  • Where a lending decision is involved, the information will aid Bank of Scotland in assessing the extent of the credit which Bank of Scotland will offer to you. In taking credit decisions Bank of Scotland seeks to protect applicants from the dangers of over-commitment. Credit Scoring may be used for credit assessment.

These uses of your personal information are covered by the Bank of Scotland and Sony's registration under the Data Protection Act 1984. Under the terms of the Act you have the right to obtain a copy of the information which Bank of Scotland or Sony holds about you, upon payment of the appropriate fee. Any references made to Sony means Sony Corporation and direct or indirect subsidiaries in any country (including Sony Europe Finance plc or other Sony group company responsible for the Loyalty Scheme*). Security

All details in the online application are fully encrypted, no matter which browser or browser version you are using.

Every application is encrypted using a Java based 128-bit encryption - the latest and most powerful encryption technology available. All Java enabled browsers (Netscape 3 and Internet Explorer 3 or better, for example) support this method of 128 bit encryption.

Credit Care

Credit Care allows you to protect your card repayments and gain additional peace of mind. If you are unable to work for at least 14 consecutive days due to an accident, sickness or involuntary unemployment, Credit Care (a) will pay 10% or £10 of the insured balance (b) (whichever is the greater). Monthly payment of your benefit will begin from the first day of your claim up to a maximum of 12 months for each claim. In the event of your untimely death, the insured balance, up to a maximum of £15,000, is paid in full. costs just 73p (including Insurance Premium Tax at the current rate) per £100 of your outstanding balance each month and in the event of a nil balance no premium is charged. The minimum premium payable is 73p.

To apply for Credit Care you must be a Principal cardholder aged between 18 and 64, a UK resident and be in full or part-time employment, working at least 16 hours per week.(c )

  1. As with other insurance policies, there are some exclusions which are detailed below. A specimen policy is available on request from Bank of Scotland, Card Services, Personal Banking Division.
  2. The insured balance is as shown on your last monthly statement and any transactions you make up to the date you become aware of your unemployment, the date you were certified by a doctor, or the date of your death.
  3. If you are not entirely satisfied with the protection offered, you can send it back within 30 days and any premium charged will be refunded provided you have not made a claim during this period.


Exclusions

As with other insurance policies there are some exclusions (these are stated in brief below). Your Credit Care policy will not cover claims arising from:


(Accident, Sickness and Unemployment)
  • Any medical condition or disease you knew of, or should reasonably have known of. In addition any medical condition or disease for which you have received treatment, advice or were referred for investigation during the 12 months before the start date of the insurance and which recurs within 12 months after the start of the insurance.
  • Normal pregnancy.
  • Self inflicted injuries or putting yourself in dangerous situations.
  • The influence or effect of alcohol.
  • Taking drugs.
  • Cosmetic surgery.
  • War and similar risks.
(Unemployment)
  • Resignation, voluntary unemployment or voluntary redundancy.
  • Misconductor any wilful act.
  • After a period of casual, temporary, short- time or occasional work.
  • Which is normal or seasonal for the occupation or at the expiry of a fixed term contract, a contract for a specific task, a period of training or apprenticeship.
  • Which you knew of or reasonably knew of at the start of the insurance.

One free call from anywhere in the world ensures any missing cards are cancelled and replacements ordered. And the cost – peace of mind for only £12 a year. FRAUDULENT CLAIM PREVENTION
Insurers and their agents share information with each other to prevent fraudulent claims via a payment anti-fraud register operated by a data administration company. A list of participants is available on request. In the event of a claim, the information you supply on the application form and the claim form, together with other information relating to the claim, will be put on the register and made available to participants.

CUSTOMER SERVICES

It is our aim with the Insurers to provide a high standard of service. However, there may be occasions when you feel that this has not been achieved. If you have any reason to complain or to enquire about the insurance cover you should initially contact SonyCard, Bank of Scotland, Pitreavie Business Park, Dunfermline, Fife KY99 4BS.

If you are still not satisfied with the way the complaint has been handled, please write to Bank of Scotland, Personal Lines, Ettrick House, 37 South Gyle Crescent, Edinburgh EH7 4AL. If the matter is not then resolved to your satisfaction, you can take the matter up with the Insurers concerned at the appropriate address. For Disability, Unemployment or Lost Card Cover write to the Creditor Claims Manager, Norwich Union General, PO Box 209, Technology Park, Dundee DD1 9EJ; For Life Cover, Claims Manager, Life Claims Dept., CGNU Life Assurance Limited, 2 Rougier Street, York YO1 1HR. Please provide details of your Card account number in order that your enquiry may be dealt with speedily.

If you remain dissatisfied you:
  1. have the right, where the Insurer is a member of the Insurance Ombudsman Bureau (IOB), to refer to the IOB, which is authorised to consider most complaints, to review your case. The Insurance Ombudsman can be contacted at Financial Ombudsman’s Service, South Quay Plaza, 183 Marsh Wall, Docklands, London, E74 9SR. Telephone 0845 600 6666.
  2. can approach the Personal Investment Authority (PIA) in respect of the life assurance part of Credit Care. The address is Personal Investment Authority, Hertsmere House, Hertsmere Road, London E14 4HB.Telephone 0207-216 0016.
If you contact the IOB or the PIA in respect of any complaint, this will not affect any right of action which you may have against your Insurers.

POLICYHOLDERS PROTECTION ACT 1975
For your added security, should any of the Insurers become unable to meet their liabilities under the policy, you may be entitled to compensation under the Policyholders Protection Act 1975. Further details are available on request from the Insurers.

CHOICE OF LAW
United Kingdom law allows parties to choose the law applicable to a contract. The contract will be subject to the law applicable to the region of the UK in which you reside. If any other law is to apply it must be agreed by both parties and evidenced in writing.

GENERAL
The insurance policies are arranged by Bank of Scotland at the above address and underwritten by the appropriate Insurers listed above. For the selling of General Insurance, Bank of Scotland is an independent intermediary which acts as your agent and accepts responsibility for the advice provided and for the arranging of your insurance. We have undertaken to comply with the Association of British Insurers' Code of Practice for the Selling of General Insurance, a copy of which is available on request. You should retain copies of all correspondence you send to SonyCard, Bank of Scotland, or the Insurers for your future reference.

CARD CARE
The insurance benefits comprised in the Card Care policy are provided through Card Protection Plan Limited (CPP), who arranges direct cover for you, as your agent, with an authorised insurance company. The Insurer has chosen English law to govern the policy. Further details and an insurance policy pack will be forwarded on acceptance of your proposal. The information which you give will be held by CPP, as agent for the Insurer, to administer the policy for which you apply.
